Following the recall of the ASR XL Acetabular System and the ASR Hip Resurfacing System, hundreds of recipients initiated filing individual and class action lawsuits against the manufacturer, DePuy Orthopaedics. These two hip replacement implants were discovered to fail within 5 years in 1 in 8 recipients. An average hip prosthesis is known to last for 15 to 20 years. A failing hip implant would mean a costly and risky revision surgery. Associating complications such as cobalt and chromium poisoning also contribute to the overall difficulty of the second hip replacement surgery. The plaintiffs believe that they should recover compensation for the losses they underwent as a result of the damages the DePuy devices have inflicted. Twelve to thirteen percent of the 93,000 recipients are known to have been affected by the DePuy hip recall. For those who have been following the DePuy case, you may have already known that an MDL ruling was given for all federal lawsuits involved.
The case was given to Judge David A. Katz of the U.S. District Court for the Northern District of Ohio in Toledo. In January 20, an initial status conference will be held fpr the purpose of determining which hip replacement lawyers will be assigned to various aspects of the case. December 23 is the last day of filing for applications to the leadership positions. Attorneys who have applied would be given two minutes each to present their reasons for applying for the positions.

In order for plaintiffs as well as the defendant to have ease of accss to relevant pretrial information, the Multidistrict Litigation was deemed necessary. Since there are a number of plaintiffs filing essentially the same type of case against DePuy, the MDL would concentrate all efforts under one case making it relatively easier for all parties involved to pursue the lawsuits. Because each case is different from each other, plaintiffs can tailor the information to their individual cases instead of receiving a lump-sum payout that they would get from class action lawsuits. Product liability lawsuits, therefore, would benefit more from an MDL rather than class action suits.
